Terms

  • DEFINITIONS : The following words or expressions shall mean: - “Pet Services Contract” shall refer to the Bark N Woof Pet services contract entered into between Client and Bark N Woof; “Bark N Woof” shall refer to Bark N Woof (a sole proprietorship with the registration no. 53088899L), its sole proprietor, management and employees; “Pet(s)” shall refer to any livestock including but not limited to dogs, cats, rabbits, and hamsters, which is mentioned in Section A of the Pet Services Contract; “Client(s)” shall refer to the persons engaging the services of Bark N Woof or otherwise is the person whose name and address appear in section A of the Pet Services Contract; “Services” shall refer to any and all product and services including but not limited to pet grooming, pet sitting, pet transport and their associated product and services that Bark N Woof may provide to Client; and “Price” shall refer to the charges for the services indicated in the Pet Services Contract and as further defined below. Words importing the singular meanings shall also refer to the plural.

  • CONTAMINATION POLICY : To ensure that there is no cross-contamination of our Client’s Pets on their return, any Pet entering our premises found to have fleas or ticks must undergo a de-ticking treatment. Should you refuse to go through with the de-ticking treatment, Bark N Woof reserves the right to refuse the provision of its services, and the Pet Service Contract shall be deemed terminated. You agree to reimburse Bark N Woof any cost incidental to the termination of the contract in such instances, including but not limited to administrative and transportation charges.

  • EMERGENCY VETERINARY CARE : Client authorises Bark N Woof to obtain emergency veterinary care for a Pet as and when necessary during the term of this contract. Bark N Woof agrees to contact the preferred veterinarian named in Section A of the Pet Services Contract. If the Client’s preferred veterinarian is unavailable, Bark N Woof is authorised to seek veterinary care from an alternate qualified veterinarian. Bark N Woof agrees to make every effort to contact Client prior to obtaining the emergency veterinary care. Client agrees to reimburse Bark N Woof for any additional fees and charges incidental to the provision of emergency care, as well as expenses incurred by Bark N Woof such as transportation to and from the veterinarian, medication, supplies, grooming, kenneling and other items related to the veterinary care.

  • PRICE : The price indicated in the “Bark N Woof Price List” are based on a per visit/per pet basis, and might be in consideration of the number and species of Pets, location of the Client’s home and number of daily visits. The full payment for all services and other charges indicated on this Pet Services Contract is due and payable upon the signing of the Pet Services Contract or upon the Client taking delivery of the Pet, whichever is earlier. As a gesture of goodwill, Bark N Woof will at times provide additional services at no extra charge to the Client. Such gestures of goodwill shall be at the sole discretion of Bark N Woof. Similarly, the provision of any pricing, promotional packages, services and incentives shall be at the sole discretion of Bark N Woof.

  • EQUIPMENTS AND SUPPLIES : The Client is responsible for supplying the necessary equipments and supplies specific to the care of the Pet(s). Where it may be necessary for Bark N Woof to acquire additional supplies and equipment for the satisfactory performance of the Services, the Client authorises Bark N Woof to make such purchase, and agrees to reimburse Bark N Woof the purchase price of the said items, as well as a service fee to Bark N Woof.

  • LIEN : Bark N Woof shall have a lien upon any Pet in their premises to secure any monies owing to Bark N Woof for any services rendered to the said Pet and the Client shall continue to be liable for all charges incurred for the duration that Bark N Woof holds the Pet because of its lien.

  • TAKING DELIVERY : If the Client wilfully and/or without due notification, fails to take delivery of the Pet within fourteen (14) days from the expiry of the services period, the said pet shall be deemed abandoned and Bark N woof shall be entitled to dispose of it in any manner that Bark N Woof deems fit without any liability to Bark N Woof.

  • LATE CANCELLATION OR NO-SHOW : Cancellation of any appointments made with Bark N Woof shall be done at least 2 hours in advance of the previously agreed appointment time. In the case of cancellation not done 2 hours in advance of the appointment time, or in the case of a no-show at the appointment time by the Client, Bark N Woof shall be entitled to claim from the Client all costs and expenses incidental to the late cancellation or no-show.

  • RIGHTS : Bark N Woof reserve the right to amend any terms and conditions, pricing and service descriptions without any prior notice to the public. Bark N Woof shall also in their sole discretion decide not to provide, refuse or reject any Pet for our services, without any prior explanations given to Client, as well as to stop and end service at any time due to situations, including but not limited to, when a Pet poses a danger to the safety or health of itself, other pets, any Bark N Woof personnel or any other individuals.

  • OBLIGATION/DISCLAIMER : It is our obligation to inform you that occasionally, grooming can expose hidden medical problems, injuries or aggravate current problems. Unavoidable or unforeseen problems occasionally arise, including but not limited to clipper or shears nicks or cuts, clipper irritation or skin redness to sensitive skin, self inflicted irritations or abrasions, the discovery of external parasites, physical or mental stresses or illness, heart attack, fits, weakness during or after the grooming sessions. Hence, while Bark N Woof agrees to provide services in a reliable, trustworthy and caring manner, Bark N Woof shall not be liable for any claims, costs and expenses of whatsoever kind or nature, which is not intentionally or negligently caused by Bark N Woof. Without prejudice to the aforesaid and subject to the terms set out below, Bark N Woof warrants that should our intentional or negligent act result in the loss, injury or death of the Pet and/or requires veterinary visits during the process of the engaged service being carried out by Bark N Woof, Bark N Woof shall compensate for any expenses and costs arising from our intentional or negligent act, but our liability shall be limited to the amount of SGD500.00 (Singapore dollars Five hundred only), subject to the following conditions (for injury or death of the Pet):-

    1.the Client shall furnish a report duly prepared and certified by a qualified veterinarian which describe and identify the Pet and the nature of the injury or death sustained and shall also confirm that the injury or death of the Pet(s) was caused solely by Bark N Woof during the duration of the services provided;
    2.in the event of the death of the Pet, the Client shall, at his own cost, arrange for a post mortem of the said Pet; and
    3.the aforesaid report(s) are to be furnished to Bark N Woof within one week from the date the Client signs the Pet Services Contract or upon delivery of the Pet(s) to the Client, whichever is earlier.

    The compensation shall be in full and final settlement of the Client’s claim against Bark N Woof, including but not limited to all consequential loss and damage the Client may suffer due to the loss, injury or death of the Pet.

  • INDEMNITY : In the event Bark N Woof is entitled to enforce the terms and conditions set out herein against the Client, the Client shall indemnify Bark N Woof for all its loss and damage arising from the Client’s non-compliance with any of the terms and conditions herein, including but not limited to all legal cost and disbursements on the indemnity basis.

  • ACCEPTANCE : The Client agrees that upon signing Bark N Woof’s Pet Services Contract, the Client accepts the terms and conditions herein without reservation or qualification whatsoever. It is understood by Bark N Woof and the Client that all provisions of this contract shall be binding upon both parties thereunto for this visit and for all subsequent visits. This contract contains the entire agreement between the parties. The Client agrees that upon signing the section B of Bark N Woof’s Pet Services Contract, the Client’s Pet is deemed to be returned in good and satisfactory condition and the services rendered by Bark N Woof is deemed to be performed and delivered in full and final. Bark N Woof shall not be held liable for any claims of whatsoever kind or nature unless it was due to the intentional or negligent act of Bark N Woof during the provision of our services.
